Terms of Service — Out of Print Cards

Welcome to Out of Print Cards ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our website located at outofprintcards.com (the "Site") and any purchases made through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on this Site. By placing an order, you represent that you meet this requirement.

3. Products and Descriptions

We make reasonable efforts to display our products, including images, condition grades, and set information, as accurately as possible. However:

• Slight variations in color or finish may occur due to photography, lighting, or screen display differences.
• Sealed product may show minor cosmetic packaging wear (see our [Returns & Refunds Policy] for details) as a normal result of distribution and handling.
• Card condition on singles is graded to the best of our ability using standard industry terminology, but grading is inherently subjective, and we do not guarantee that our grading will match that of any third-party grading service.

We reserve the right to limit quantities, refuse or cancel any order, and correct errors in product listings, descriptions, or pricing at any time, including after an order has been submitted.

4. Pricing and Payment

• All prices are listed in [USD] and are subject to change without notice.
• In the event a product is listed at an incorrect price due to a typographical, technical, or pricing error, we reserve the right to cancel the order, refuse or cancel any orders placed for that product, and refund any amount charged, whether or not the order has been confirmed.
• Sales tax is calculated and applied in accordance with applicable state and local law based on your shipping address and our tax registration status. See our note on sales tax below.
• Payment is processed securely through Shopify's payment infrastructure. We do not store your full payment card information.

5. Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason after receipt, including but not limited to product availability, errors in pricing or product information, or issues identified with your order or payment.

6. Shipping

• Shipping timelines and rates vary by product type and are displayed at checkout.
• Risk of loss and title for items purchased pass to you upon our delivery to the carrier.
• We are not responsible for delays caused by the carrier, customs, or events outside our reasonable control.

7. Returns and Refunds

All sales are subject to our [Returns & Refunds Policy], which is incorporated into these Terms by reference. In summary: sealed product is final sale except where we shipped the wrong item; singles may be returned within a limited window for defined condition or authenticity issues. Please review the full policy before purchasing.

8. Intellectual Property and Trademark Disclaimer

Out of Print Cards is an independent retailer and is not affiliated with, endorsed by, sponsored by, or officially connected to Nintendo, Game Freak, Creatures Inc., The Pokémon Company, The Pokémon Company International, or any professional sports league, team, or players association whose licensed trading cards we may sell. All product names, logos, brands, and trademarks referenced on this Site are the property of their respective owners and are used solely to identify the products we sell.

All content on this Site that we created — including our own logo, branding, site design, and original written content — is the property of Out of Print Cards and may not be copied, reproduced, or used without our written permission.

9. Authenticity

We guarantee that all product we sell is authentic and vetted. If you have reason to believe an item you received is not authentic, contact us immediately at upsidecollectibles@gmail.com so we can investigate.

10. Limitation of Liability

To the fullest extent permitted by law, Out of Print Cards and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any product purchased through it, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your order will not exceed the amount you paid for the applicable product.

Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Account Registration

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.

12. Prohibited Uses

You agree not to use the Site to:

• Violate any applicable law or regulation
• Attempt to gain unauthorized access to any part of the Site or its systems
• Use automated means (bots, scrapers) to access the Site without our prior written consent
• Submit false or misleading information, including fraudulent payment information
